Hunting in Sardinia - Following an appeal presented by some environmental associations the Tar Sardegna has suspended the first days of hare and partridge hunting. The judges thus accepted the precautionary petition of the appeal filed against the new one hunting calendar 2018/2019 approved for hunting in Sardinia on 20 July. In fact, the Regional Department of the Environment had planned two days for these two species: the September 30 and October 7. On the other hand, the administrative judges, who said yes to the thesis of the lawyer Carlo Augusto Melis Costa, defender of the Legal Intervention Group (GRIG), Lega Ambiente, Wwf, league for the abolition of hunting and Lav against of the Region, formed in court with the lawyers Giovanni Parisi and Roberto Muroni.
Il Administrative Court of Sardinia, The board of the first section of the Sardinia TAR, chaired by Dante D'Alessio, alongside Giorgio Manca and Gianluca Rovelli, considered valid the reasons for suspend the 2018/2019 hunting calendar in the part relating to the Sardinian hare and partridge.
According to the judges, in the light of the studies attached to the case in question, the Region of Sardinia may depart from the conclusions of Ispra (which pronounces on the congruity of the calendar with respect to the needs of wildlife protection) only if it provides adequate motivation, but the decision of the regional administration cannot be in contrast with what is established by the technical body. "While taking into account the discretionary powers of the Region - reads the ordinance - the verification of the intrinsic coherence of the contested provision with respect to the cognitive data acquired in the procedure leads to the belief, even in this precautionary phase, that the vices alleged by the applicant associations cause".
Since the ball now passes to the Council of State, we will see if there are any developments.
