Owner of 3 supermarkets remains without firearms license for not paying taxes and for hygienic violations in one of his businesses. This is the story that comes from Orta di Atella where a man, owner of a supermarket in the Atellana city but also in Sant'Arpino and Santa Maria a Vico, found himself without a gun permit after the decision of the Prefecture of Caserta to reject his request for renewal despite the fact that the man had to withdraw the cash collected in the various operating offices, in order to keep them up to the material deposited with the credit institutions.
The trader had said that the weapon was needed for personal defense but the Prefecture highlighted that "the applicant is burdened with some criminal records (two criminal convictions concerning the failure to pay social security contributions and the violation of hygiene rules within a commercial establishment) ". Even the regional administrative court of Campania agreed with the Prefecture because "the license to carry a pistol for personal defense is exceptional, constituting the general principle of the legal system thatself-protection it can only be allowed in cases of extreme necessity, if any other way is precluded ".
Because according to the judge, “the protection of citizens' safety is delegated to police, and for this purpose the good conduct of the applicant or the absence on the part of the same of convictions or conducts that affect his reliability are not sufficient, but assuming the demonstrated and current existence of an exceptional need for self-defense.
This proof therefore weighs on the private individual requesting the firearms license, who every time he applies for renewal must demonstrate the relevance of the self defense needs, the mere belonging to a professional category or the performance of a specific economic activity or the presence of significant amounts of money". With a long sentence, the president Maria Abbruzzese therefore rejects the request and condemns the appellant also to pay 1500 euros in favor of the Prefecture of Caserta, which has appeared in court (Caserta News).
