The First Section of the Regional Administrative Court of Sicily expressed itself on the appeal presented by a man against the Prefecture of Palermo to cancel the revocation of the rifle port license. This decree dated back to 2008, when the police had decided to prevent the release of the license for sports use due to the encounter of this person with a victim in the main square of Montelepre, in the province of Palermo.
The only meeting made the reliability of the person presenting the appeal undermine, taking into account the fact that the other person had precedents for criminal association of a mafia type. The appeal was accepted by the TAR, given that there would not have been a constant attendance in addition to the contested circumstance. Reliability can be deduced from knowledge of this kind, but at the same time they are necessary repeated and continuous encounters, as well as proven.
Among other things, the applicant's conduct was found to be normal and immune from criminal records and pending, a detail of no small importance for this assessment. The measure could only be illegitimate and to be canceled. The ruling is final and the administration was ordered to pay the litigation costs, specifically 1500 euros.
