The section Prima Ter del Lazio Regional Administrative Court dealt with the appeal of a man against the non-renewal of the license of port of gun for self defense by the Rome Police Headquarters. This is a measure dating back to 2009 and motivated by the fact that this person was involved in an investigation for embezzlement, scam e threat.
The appeal was based on the fact that the holder of the firearms license, owner of a jewelry store, had obtained the license since 2000, without ever having been convicted of the crimes mentioned above. The Lazio Regional Administrative Court found that the man was also accused of insult, therefore, the criminal proceedings justified his unreliability as regards the possession and use of weapons. The applicant's conduct was not found to be adequate.
The administrative judges, then, underlined the dismissal of the facts and the failure to condemn in the total absence of witnesses, a circumstance that in any case must be disconnected from the use of weapons. The man was sentenced to refund the costs of litigation to the administration, paid in a thousand euros plus legal accessories. The jurisprudence on arms is therefore enriched by a new precedent to which reference cannot be made.
