With appeal proposed in the month of August 2021 the Associations Legambiente Sicilia, WWF Italia Onlus and LIPU have appealed to the TAR Sicily - Catania and challenged the Assessorial Decree with which the Regional Department for Sicilian region to Agriculture, Rural Development and Mediterranean Fishing approved the hunting calendar 2021/2022. In order to defend the legitimacy of the hunting calendar, the UN.A.VE.S. (Union of Sicilian Hunting Associations) has appointed the lawyers Girolamo Rubino and Massimiliano Valenza of the Palermo bar, who will explain the defenses in the aforementioned judgment, pending before the TAR Sicily, seat of Palermo. Already in 2018 the CGA, on the basis of the defenses of UN.A.VE.S. had appointed a Technical Consultant with the task of assessing whether the forecasts of the regional hunting calendar not in line with the ISPRA opinion were legitimate. Furthermore, in 2020 on the basis of the defenses of UN.A.VE.S., always assisted by the lawyers Rubino and Valenza, the CGA had ascertained that "the opinion of the ISPRA did not contemplate any specific constraint that the Region can say unjustifiably unnoticed". In doing so, the CGA had posed a further important stake to contain the claims of environmental associations. On the basis of the important measures already obtained in the past, therefore, an age-old conflict continues in the current year which always places at the center the issue of defining the margin of discretion of the Sicilian Region with respect to ISPRA prescriptions, as well as with respect to the assessment of the conditions for the opening of the hunting activity. The TAR Sicily has set the council chamber for 27/10/2021, the day on which it will be necessary to intervene once again to establish the extent of the powers of the regional administration on the contents of the hunting calendar, and conversely on the limits imposed by state legislation on the activities of the regions.
