By order published today (no. 75/2021) on Administrative Court of the Marche ruled rejecting yet another administrative appeal (no. RG 102/2021), presented by the animal welfare associations LAC, ENPA, LAV, Lupus in Fabula, for the cancellation after suspension of the Control Plans of Fox and Corvid species, approved by the Marche Region with DGR n. 1536/2020. In defense of the provision, the main regional associations appeared in the judgment ad opposendum Libera Caccia, Arci Caccia and Federcaccia, representing hunting and environmental interests, sponsored by the lawyers Osvaldo Lucciarini and Giovanni Fattorini.
In particular, the Marche Regional Administrative Court, fully acknowledging the exceptions of hunting representatives, considered that the precautionary conditions underlying the appeal did not exist, noting that art. 25 of the Regional Law 7/1995 is perfectly compliant with the national framework law n. 157/1992, where, acquired the favorable opinion of ISPRA, provides for the possibility of implementing plans for the culling of supernumerary species. The TAR therefore confirmed the legitimacy of the Control Plans drawn up with commitment and competence by the regional offices and by the technical drafters. The decision in question clarifies the regulatory framework after two recent sentences of the Constitutional Court; in fact, for years, erroneous interpretations have favored the failure to adopt an effective control system on “opportunistic” predators, a necessary and constant control required by the undersigned hunting associations.
The order of the TAR must be considered one "Victory for the protection of the ecosystem", as the concrete implementation of the Control Plans will allow the conservation of numerous species belonging above all to small fauna, including those of not purely hunting interest, species threatened by the massive presence of "opportunistic" predators. Therefore, in the precautionary seat mentioned above, it was guaranteed the regular continuity and good functioning of the wildlife hunting sector in terms of land management, avoiding the prejudice of any form of biodiversity, as one would have risked in the denial succumbing to yet another ideological attack, aimed at unjustly compressing collective interests.
