The Third Section of the Court of Cassation it ruled on taxidermy and on the applicable sanctions, recalling the second paragraph of article 30 of the Hunting Law, the one that establishes the fines on embalming. A man appealed after the Udine Court sentenced him to one fine of 1200 euros for driving their own car with hunting equipment aboard in the protected area of the Julian Prealps Regional Natural Park and for having detained at home stuffed specimens of particularly protected wild birds.
According to his point of view, in particular, the possession of the remains of taxidermized animals is not a crime, since the detention can only refer to thelive animal. The appeal was held partially founded, but only in relation to the ban on hunting and the equipment present in the car.
As for the crime of keeping stuffed birds, the judges held that the home belonged to the person who appealed: the man's father was also present during the search, but the taxidermized birds could not in any way be linked to the parent. Finally, according to the Supreme Court, the Court did not rightly give weight to the depositions of the mother and sister of the applicant, contradicted by numerous evidence to the contrary.
