The news was long awaited: the Senate of the Republic approved the reform of the self-defense with 201 votes in favor and 38 against. The path of this normative text is now complete after the third reading and the changes made over the last few weeks. Specifically, the first article of the bill was meant for change article 52 of the Criminal Code. In practice, the proportionality between offense and defense must always exist.
The criminal does not necessarily have to have the weapon in his hand to trigger self-defense, the threatens to use a weapon. Furthermore, the same threat does not have to be explicitly addressed to the person. The culpable excess and its discipline are explored in the second article, the one that provides for the non-punishment for those who defended themselves in the presence of a serious disturbance caused by the dangerous situation.
The penalties against thieves will be more severe. More specifically, the maximum penalty for the housebreaking it will rise to 4 years, while for home theft and theft it will go from six to seven years (minimum and maximum limit).
