While public opinion has to live with the wild boars among the bins of Rome o at the Careggi Hospital in Florence, while there are worrying increases in road accidents (even mortal) and considerable damage to agriculture and livestock, the usual suspects LAC, LAV, ENPA, WWF continue to present appeals to the TAR against regional regulations for prevent the necessary containment. A few weeks ago, the aforementioned associations filed with the TAR Toscano, the appeal for the cancellation of Control plan 2019/21 on the wild boar species approved by the Tuscany Region.
In the appeal the applicants contested the form of the hunted as a modality for the control of the wild boar species pursuant to article 37 of Law 3/94. In essence, it is argued that this method does not respond to the opinions and observations provided by Ispra since it does not respond to selectivity criteria and that control activities should only be applied following the use of ecological methods. Furthermore, the issue concerning the alleged constitutional illegitimacy of article 37 of Law 3/94 paragraphs 3,4,4 ter is also raised with reference to article 117 paragraph 2 letter S of the Constitution in the part in which they are authorized toimplementation of control interventions also the qualified subjects in addition to the hunting guards, the owners and conductors of the funds, the forest and municipal guards with a hunting license.
A possible decision of acceptance of these requests or the eventuality of the acceptance of the request for suspension by the TAR Tuscany, could in fact seriously jeopardize the continuation of the control interventions, in art. 37, causing inevitable negative repercussions for ATC budgets, for damage to crops in a very delicate time of the year and for the consequences on biodiversity and intraspecific relationships for the various species of wildlife. The Confederation of Tuscan Hunters will carefully follow this new front in the certainty that the Tuscany Region takes care of prepare the necessary counter-arguments against this latest attempt at attack to the role and competences that are due to you. In the meantime, we want to underline some good news concerning precisely the argument of constitutional legitimacy on the reliance on the culling of subjects authorized to control. A similar appeal presented by the same animal-environmentalist cartel to the Lombardy Regional Administrative Court, has seen this objection rejected by the same. A good precedent that we hope is also followed in Tuscany.
