However, the CCT confirmed its opinion: the reasons that led to the act of the Government (considered an unspeakable abuse of power) are considered inconsistent and the way in which the whole affair was handled was also stigmatized, particularly from a formal point of view.
As remembered by the association, at this point the TAR will have to set the Council Chamber for the collegial examination, with the consequent decision of the hearings on the merits. What prompted the Tuscan administrative judges to reject the suspension requested by the hunters? The associations gathered in the CCT had highlighted, in particular, how the data and scientific results for hunting scheduling they cannot be limited to the borders of national territories, but extended to homogeneous international contexts when it comes to migratory species.
Furthermore, the incongruity of the hunting calendars of the French departments Haute Corse and Corse du Sud was highlighted, in which the deadline is February 20, a difference between Tuscany and Corsica that is unexplained, as the Italian region and the French island are similar as far as concerns are concerned migratory routes, wintering areas and geographic and climatic characteristics. A further reason for the appeal was that of the excess of power due to misuse. Among other things, the early closure would cause serious and irreparable damage to the associations that have resorted to the TAR and to the thousands of Tuscan hunters who are represented by them.
The document presented in this case relied on the impossibility of the category to exercise a legitimate right (that of hunting obviously) so they have paid government and regional taxes based on the calendar of the Region. The same goes for the hunting sector as a whole and the related industries. In fact, the elimination of two weekends (January 23-24 and January 30-31) is about to result in one reduction of the tourist-hunting flow and of the receptive and tourist one, supported by the mass of hunters.
