The discussion is scheduled for today at TAR Tuscany of the appeal presented by the Environmentalist and Animalist Associations relating to the Hunting Calendar 2018/2019 of the Tuscany region. Following the order of the Council of State which accepted the request for suspension on some parts of the calendar now it will be the TAR to express itself on the merits of the arguments advanced by the applicants and on the copious and timely counter-arguments put in place by the Tuscany Region and by the lawyer appointed by National Federcaccia, Federcaccia Toscana and the Tuscan Hunters Confederation.
After weeks of controversy and the heavy repercussions suffered on the early closure of some migratory species, the legal battle will have to lead the judges of the TAR to express themselves on the merits of the contents of an appeal that risks open insidious precedents, not only for Tuscany, but more generally for the articulation of the various hunting calendars of the Regions. The work carried out in recent months by the law firm in charge has led to the drafting of a large memory that will represent the backbone of the arguments that will be supported in the classroom. A detailed examination of the issue relating to the calculation of the time period, with particular reference to the species subject to pre-opening and the correct interpretation of the Ispra opinion of 17 September 2010.
The firm dispute on the generic nature of the arguments of a precautionary nature accepted by the Council of State, relative to the times of harvesting of woodcock. During the drafting of the 2018/2019 calendar, the Region had supported the forecast of the sampling of the species as of 31 January in the face of data, monitoring, divided into 10 years of studies that went beyond the critical findings imposed by the Ispra opinion. Today, therefore, will be determined a decisive step which cannot be ignored the future evaluations on the next hunting calendar 2019/2020 and on the proposals to be presented and supported in the future discussion tables with the Tuscany Region.
For the results of this sentence and to know the merits of the judgment of the judges, unfortunately we will have to wait a few weeks. As far as we are concerned, it is clear that the utmost efforts have been made to best support this important step. A concrete job, which we hope will produce useful results for all hunters and restore legal certainty to them.
