Two days ago the First Section of Regional Administrative Court of Umbria examined a man's appeal against the Prefecture of Perugia. In short, this person demanded the lifting of the ban on the possession of weapons and ammunition. The prefectural provision was made necessary due to the hunting activity carried out within the Sibillini Mountains National Park: the appeal was based on the fact that there would be an excess of power and the misrepresentation of the facts.
However, the request was rejected. According to the TAR, in fact, the behavior that led to the ban cannot be considered irrelevant to the judgment on the use of weapons, despite the prescription and the non-place to proceed. The prescription, therefore, does not prevent the evaluation of the historical fact and its objectivity, which is fundamental for understanding the reliability or otherwise of the subject.
The same goes for the danger of the person being examined. As required by the internal regulations, in the Parco dei Monti Sibillini they can carry hunting weapons those who are authorized by the park authority to selectively collect the wild boar, but limited to the transfers necessary for carrying out the activity.
