Hunting in derogation: the hunting associations gathered in the Cupav Brescia express their criticisms to the Lombardy Region for the question of exceptions, "the story of an announced betrayal".
The hunting associations Lombard Hunters Association, National Free Hunting Association, Anuu Migratoristi, Arci Caccia, Caccia Pesca Ambiente, Enalcaccia, Italian Federation of Hunting, Italcaccia members of CUPAV Brescia, having read the bill licensed by Commission VIII on 19 cm in hunting matters in derogation express their total opposition, both in relation to the choice to delegate the Lombard Provinces to adopt the derogatory regime and in relation to the modalities of the possible exercise of the same. They are also bewildered by the way the regional bodies act completely contrary to the expectations of the hunting world and by the promises made in the various public meetings with the hunters.
On the first point it is evident the inability and the deliberate lack of the regional legislator who, in the face of the "threats" of community sanctions proposed by President Formigoni, does not find better than to discharge the responsibilities to the Provinces, making the idea that for this reason in the in the event of community censorship, no million-dollar penalties will be imposed.
The regional "Pontius Pilates" forget that the Law of the State n. 11 of 2005, article 16bis states that the State in case of community sanctions will compete against the institution that caused it (including local authorities) for having adopted measures in contrast with EEC regulations.
The Regional Councilors forget that the vast majority of Lombard Provinces (if not all ...) will not adopt acts of derogation, with the result that hunters from Brescia and Bergamo use to hunt from stalking in the Provinces of Mantua, Pavia, Cremona, Lodi and others will be forced to give it up.
How many to the application contents present in the approved project, it is difficult to understand how it is imagined to arrive a few days from the possibility of hunting the species in derogation with methods that provide inapplicable and unacceptable rules and times.
In detail, it is not clear why the withdrawal is allowed only from fixed and temporary stalking: what sentence or formal notice of the European Community support this limitation? NONE!

Given that the Provinces must share the quantity fixed by the Region itself, it was more appropriate and sensible that the game bag was established by dividing the total quantity of the individual species by the number of hunters (albeit presumed) admitted to the derogation.
Why was it invented to establish that deliberate items must be noted on the card once they have been knocked down and hinged? Beyond the legislative confusion, the Lombardy Region has not prepared a hunting card that allows this operation!
Finally, it is not clear why in the face of the statement of President Formigoni who refers to what has been established several times by the Constitutional Court, the Region has not evaluated the hypothesis of an administrative act through the Regional Council.
Therefore, the Lombard Councilors are invited not to abdicate the legislative role that belongs to them and to approve the law that allows the withdrawal in derogation on the entire Lombard territory avoiding embarrassing delegations to the provinces.
If the Lombardy Region in times of economic crisis, recalling that hunting occupies over 90.000 jobs (most of which in the Lombardy Region), intends to tackle the problems of the territory as it is managing hunting, we express deep concern for our future. of Lombard citizens.
