Il Regional Administrative Court of Puglia accepted the appeal of a hunter residing in the province of Foggia against the Prefecture, the Ministry of the Interior and the Police Headquarters. Everything was born following a decree of Prefect of Foggia and another of the Quaestor, according to which the possession of weapons and ammunition to man should be prohibited, in addition to the revocation of the license of the rifle port.
The facts date back to 2009, when the hunter defended a English setter from the aggression of a pit bull, killed to ensure the physical safety of the other dog. The judges of the TAR explained that the use of the weapon for personal defence or, without fault, in the exercise of hunting. Consequently, the complaints of inadequacy of the reasoning were upheld and the revocation of the firearms license was canceled.
Prohibition and revocation were motivated by the mistreatment and killing of the pit bull, as well as dangerous explosions. The administrative judges also clarified another point: in fact, it would have been necessary to give a adequate feedback on incorrect use of the weapon (legitimately held) and consistently with a system of laws that allows its use. For the moment the hunting license is safe.
