Il TAR Milan filed the sentence relating to 2020/2021 calendar. The TAR did not enter into the merits of claims of the LAC: the decision was in fact considered of no interest to the LAC since the calendar obviously ceased its effects on 31.1.2021 and, the Judges observe, it is not possible to know in advance how the Region will regulate next season. The TAR also underlined that LAC had challenged only the "Reductive calendar" (relating to lark, quail, fighter, tufted duck, pochard, lapwing and ptarmigan) and not also the "supplementary calendar", which must be considered the basic calendar for all species. However, a few emerge from the TAR's decision useful indications for next season:
1) We must expect that for the next season the LAC will challenge every calendar act (supplementary, reductive, supplementary days, etc etc) that will deviate from the opinion of ISPRA.
2) The TAR in saying that it cannot be expressed on the old calendar to give indications for the next because it will be based on different data, clearly tells us that the regional law 17/2004 is not the calendar. Moreover, the TAR itself could as a precautionary measure (as it did in 2020 by prohibiting hunting in the SPAs of Brescia, Lecco and Cremona) expressly PROHIBIT the taking of certain species where the Region does not validly and punctually justify the deviation from the ISPRA opinion.
In short, the "Calendar Law" of Lombardy today no longer gives any guarantee for the continuity of the season in the event of "suspensive" and we hope that the Region does not rely on it, but take a clear and well-motivated position on all the points of the ISPRA opinion so as not to leave Lombard hunters at the mercy of events "because there is so much the regional law of 2004", which in fact is a parachute that does not open (Source : Federcaccia Lombardy).
