Il Regional Administrative Court of Umbria accepted the appeal of a hunter resident in Terni to whom the license had been suspended from the Police Headquarters. In short, the judges of the TAR asked the Constitutional Court to pronounce on the matter, therefore the revocation was in fact "frozen". The same happened in the case of two Tuscan hunters who had seen each other deny renewal from the Grosseto Police Headquarters. What exactly happened?
The man was convicted several years ago for a criminal offense, only to be rehabilitated later. According to his lawyer, however, crimes such as theft or attempted theft lead to failure to grant a firearm license even after a long time. The same lawyer believes that such a rule is unconstitutional. Consequently, the Council will have to express itself and a clearer picture will be obtained. In the event of a favorable sentence all hunters and gun owners living in Umbria and who have precedents they might hope for.
The goal is, as always, to understand if the hunter or owner of any weapon is dangerous after a crime far in time and a certified rehabilitation. Up to this ruling of the Umbria Regional Administrative Court, the administrative judges they had always rejected appeals, then a small crack is visible.
