Letter to councilor Mammi
The Emiliano Romagnole hunting associations Federcaccia, Arcicaccia, Liberacaccia, Italcaccia and Enalcaccia, following the meeting which took place in the Region on Hunting Calendar and the actions consequent to the ordinance of the Bologna Regional Administrative Court of 7 September, they clarified in a letter sent to the councilor Alessio Mammi, Agriculture and agri-food, hunting and fishing of the Emilia Romagna Region and for information to the managers of the connected sectors, their position and the their requests.
The text of the joint statement
Below is the text signed by the regional presidents of the aforementioned associations:
“Dear Councilor Alessio Mammi, in reference to yesterday's meeting with your structure, during which it was possible to detect a shared desire to provide answers regarding the legitimation of hunting and the rights of hunters, continuing hunting activity despite the unjustified intervention by the TAR of Bologna to suspend the hunting calendar of Emilia Romagna, as hunting associations we reiterate what was stated in the meeting mentioned above and more precisely:
– it is absolutely necessary to appeal to the Council of State against the sentence of the TAR of Bologna, using the reasons highlighted by the lawyer. Alberto Maria Bruni: the evident over-power of the TAR, imposing the opening date of the hunt on October 1st; having set the date of discussion on the merits for 26 March 2024, when the Calendar is no longer active; Lac's failure to notify the appeal to a direct interested party, hunting associations or individual hunter;
– hunting activity must be absolutely guaranteed in the month of January 2024 within the terms set by the hunting calendar, which is the subject of the appeal. In this regard, it will be necessary to strengthen the technical-scientific and legal contents used up to now. We take this opportunity to invite the regional technical offices to pay greater attention in the construction of the documents in support of the hunting calendar and to use the technical material sent by the hunting associations and that available from specific studies carried out.
Other details
– all checks must be carried out on the feasibility and legal opportunity to guarantee the opening of the permanent hunt on 17 September. The Emilia Romagna hunting associations believe that it cannot be the TAR that sets the opening and closing dates of the hunt, but Law 157/92. In the event that it unequivocally emerges that it is not possible to keep the opening date of the hunt on September 17th, with the consequent postponement to October 1st, the sedentary hunting days not used by the hunters will have to be made up for, extending the hunting season by a week. closing of hunting activity in December. Furthermore, the continuity of hunting and dog training, currently in place, must be guaranteed until 1 October.
