Hunter sues the ministry to get gun and rifle license back. The judges, however, did not accept the appeal of the man, resident a Brugherio (province of Monza-Brianza): he will have to say goodbye to double goals. At the Regional Administrative Court of Lombardy, the lover of hunting had appealed to challenge the decree issued by the Milan's police headquarters in 2017, with which he rejected the request of renewal of the firearms license for hunting rifles. That "no" was assessed by the applicant as unjustified, deciding to drag the Ministry of the Interior defended by the State District Attorney into the courtroom. The judges of the Tar are quite different.
First of all there are the sentences imposed by the Court of Appeal for bankruptcy fraudulence continued in competition and for receiving stolen goods, even if the Court of Milan in 2007 had granted rehabilitation. Then there is also the complaint handed over to the Brugherese by the Brugherio Carabinieri, who in 2016 deferred him to a state of freedom for the violation of the legislation on gun control, for the crime of abusive detention and failure to report them. In fact, his permit to possess them had already expired at the time, but the hunter still moved them from one place to another. A story that was extinguished by oblation, but which nevertheless (like the two criminal convictions) weighed on the choice of the Police Headquarters and on the verdict of the judges.
There is no right to possess or bear arms, highlighted by the TAR: the license is a departure from the normal prohibition, which those who request it must substantially demonstrate that they deserve. And this is not the case with the Brugherian hunter, at least according to the decision by the Lombard Administrative Court, which sentenced him to payment of litigation costs paid in two thousand euros (Primalamartesana.it).
