HUNTING IN DEROGATION: THE TAR OF VENETO AGAIN SUSPENDS HUNTING IN DEROGATION FROM PEPPOLE AND TRANSFERS
VENICE (2 December) - Animalists 3 - Region 0. If it were a football match the result of the match in front of the TAR of Veneto between the associations and the institution would be this. And the last point, the animal rights activists, have marked it just today: the TAR has in fact rejected for the third time a provision to derogate from hunting, which made it possible to kill protected birds such as starlings and brambles, supported by Palazzo Balbi.
"This is the third consecutive victory of the animal rights and environmentalist associations against the" shooter "resolutions promoted by the councilor Elena Donazzan, heralded as legitimate by the MEP Sergio Berlato". The president of the Lac del Veneto Andrea Zanoni thus comments on the decision of the Regional Administrative Court on the regional resolution approved on 24 November last which allowed hunting in derogation for starlings and brambles.
"We must add - continues Zanoni - that in recent days Lac, Enpa, Lav, Legambiente, Lipu and WWF have filed a detailed complaint with the Venice Public Prosecutor's Office regarding the three resolutions on the hunting of protected birds approved by the Veneto Region . I hope that after this third rejection the hunters will realize once and for all that hunting in derogation is illegal. There is an urgent need for a law that provides for the costs of these illegal resolutions to be charged directly to their promoters. The costs for appeals to the TAR, for the sanctioning procedure opened at the EU, the sanctions that could arrive from the Court of Justice for the violation of the birds directive, must be paid personally by Galan and Donazzan and not by the citizens.
Veneto as unfortunately happens now. From today - he concludes - the Venetian hunters no longer enjoy the “Galan 'award” which gave them immunity from the crime of poaching ».
"The suspension of the Tar is valid until December 17, 2009, the date on which the hearing on the merits will be held to assess the reasons of both the applicants and the regional council ": MEP Sergio Berlato specifies this in a note, commenting on the decision of the Veneto TAR (" unheard of part ", underlines the exponent of the PDL).
"On December 17, therefore, the TAR, - continues Berlato - after hearing the lawyers of the parties involved, will decide whether to confirm the suspension of the hunt in derogation for the remainder of the 2009 hunting season or to allow it to be completed until December 31, as foreseen by the resolution of the regional council ».
According to Mr. Berlato, “it is singular that the Tar judges have decided to suspend the regional resolution on hunts in derogations without allowing the Regional Council to defend its own provision issued in full compliance with national laws and Community directives. In the hearing on the merits - he concludes - we will see if the judges of the TAR of Veneto will have the goodness to read the documents attached to the regional resolution or if they decide to confirm this 'unprecedented' suspension measure ».
