The Marchigian sentence
The third section of the Council of State cancels, with an Ordinance that leaves no room for doubt, the decisions of the TAR of the Marches regarding the appeal of animal welfare associations against the hunting calendar. So after Emilia Romagna also the Marche Region is sanctioned by the judges of the Council of State for the choices made endorsed by the administrative judges. Basically in this Region the supplementary days in October and November go from two to one, the closure of the collection of thrushes and woodcock is anticipated and the environmental damage caused by the opening of the fighting species is stigmatized, opening granted from the third Sunday of September to October 31st. We can only take note of the guidelines of the Council of State, peremptory and without the possibility of interpretations: according to the judges, the opinion of Ispra, although not mandatory, although not in line with the scientific results of the other European countries, although not technically motivated in its remarks, must be accepted in full. Let's say that the Council of State was a bit of a leveller, it brought all the Italian regions back to the same level, unfortunately the Lombard one. In this way, however, it has made it very clear where the problem lurks or rather, in which area one must act to try to partially resolve these problems, i.e. ISPRA. Otherwise dear gentlemen we must begin to realize that the hunt will no longer open on the third Sunday of September, but on October XNUMXst with all the consequences we know well. We must also be aware that this trend will lead to an early end of the hunting season as early as next year, just as the possibility of having two supplementary days from a fixed hut in October and December will become a chimera.
The role of the Government
The word now passes to the Government, above all to that department, the Ministry of the Environment, which has Ispra under its protective wing. We have written it and rewritten it: for our part we would not like a pro-hunting Ispra just as we obviously do not want it ideologically anti-hunting. We would like to discuss with an institution moved only by scientific reasons, whether they are in our favor or against. Today a political party that is more in favor of hunters and perhaps in a few years clearly against it could put its hat on it: we would all lose in the face of a lack of management of the wildlife heritage, hunters and environmentalists. A bit like what happened in the Lombardy region last week. Rumors in the corridor tell of a president Fontana annoyed by some amendments presented within the statutory law: they were harmless amendments and reorganization of the matter. As a reaction then, some councilors who have always been close to the hunting world, specifically Barbara Mazzali and Floriano Massardi, presented some amendments to the Commission on well-known and very attentive issues by us hunters, the rings of decoy birds, without wanting to mediate their positions. However, the Commission rejected them, essentially splitting the majority: Massardi and the advisers of the Brothers of Italy in favour, Lega and Forza Italia against. Obviously we don't know the real reasons for this clash but one thing is certain: the problems of the hunting world, specifically the little ring issue, have not been resolved. Accusations are chasing each other, motivated by both factions but the substance doesn't change for us because our issues remain at the stake. Perhaps a greater capacity for dialogue is needed on the one hand, but a strong political will is also needed on the other.
A dialogue table
The Ordinance of the Council of State from which our reflections started clearly clarifies to us that the terms of the hearing are in Rome, Ispra, the Ministry of the Environment and also that of Agriculture. In the Regions attempts are made to legislate to fill regulatory gaps, the lack of updates of national laws but if these "regional recipes" are not packaged with wisdom they turn into political dialectic, into a clash between rival factions even within the same party. It's not a good show, the Lombardy Region didn't make a good impression: on the one hand, President Fontana shouldn't be surprised if the hunting world tries in every way not to drown in the sea of animal rights attacks and should perhaps try to understand better the our reasons given the upcoming electoral deadlines. On the other hand we see commissioner Rolfi failing to find a table for dialogue with some majority councilors, constructive dialogue of course, to arrive at some acceptable result.
