Federcaccia, appealed against the resolutions of the Council of Ministers and the Ministry of the Environment regarding the timing of the hunting to some species of migratory fauna.
The appeal against the decisions taken by the Council of Ministers on 20 January has been filed with the Lazio TAR. For Federcaccia an act due to a principle of respect for the rules and competences of the Regions, as well as in defense of migratory hunting, which was the subject of an unmotivated and unprecedented provision. The Bruni-Morbidelli law firm of Florence filed before the Lazio TAR the appeal of the Italian Federation of Hunting for the annulment of the resolutions with which the Presidency of the Council of Ministers ordered, making use of the exercise of the substitute power, the modification of the hunting calendars of the regions of Friuli Venezia Giulia, Veneto, Marche, Liguria, Umbria and Tuscany and of all the previous and consequent acts of this procedure with which the sampling times for cesena, song thrush and woodcock. A full-bodied and detailed legal document, enriched by a technical-scientific part edited by the FIdC Bird Migration Office.
Alongside the FIdC also Arci Caccia, ANUU Migratoristi and Enalcaccia, joined by some hunter citizens residing in the regions concerned, bearers of a primary and direct interest in the annulment of the contested acts that have infringed their right to exercise the activity hunting. The appeal is intended to be the manifestation of the firm defense of a higher principle of respect for the rules by everyone: seeking recognition of the validity of last season's hunting calendars, which immediately led Federcaccia to reaffirm and defend the constitutional autonomy of the Regions , alongside which it has sided, asking for compliance with the national and international regulations in force and with the lines of action in the environmental wildlife field established by the European Union, applied in all member states and which must also be guaranteed in the drafting of the next calendars hunters.
For the same reason, with the utmost respect for roles and different sensitivities, and without affecting the collaboration commitments signed in other fields, Federcaccia dissociates itself from Legambiente's interpretation regarding the restriction of the withdrawal period of song thrush, cesena and woodcock, three species in a good state of conservation (Birdlife International), finding it at least hasty and not supported by correct technical, legal and scientific assessments.
We believe that reducing the sampling times of those three species by ten days is not the correct response of the State to the EU Pilot procedure from which the story began, but rather undertakes to observe the provisions of article 12 of Directive 2009/147. / EC "Birds" (Conservation status of the species, relative data collection and implementation of the management plans of the species envisaged by the Commission) which currently sees Italy in default, and for which hunters could make a significant, indispensable, contribution .
What is certain is that if the Government does not change its approach to the issues of the environment, fauna and hunting, it is not difficult to predict in the light of what has happened that from now until the next hunting season there is a risk of a new phase of discussion on the calendars in front of the TAR, with the rekindling of a conflict that no reasonable party feels the need and from which no one would emerge victorious.
Trusting in a response from the administrative justice that sees the principles of law and legality referred to recognized, Federcaccia confirms the will to defend all forms of sustainable hunting practiced in our country, in particular those traditional to migration, which often suffer limitations in Italy. higher than the provisions of the Birds Directive and the Interpretation Guide itself, or those technical-regulatory requirements which the Regions had adapted to set the calendars for 31 January.
Federcaccia for its part will still put all its efforts to reach a definitive solution in compliance with the rules and with the contribution of the necessary scientific documentation, by virtue of that sense of collaboration with the institutions that has always been part of its culture and tradition . The hope in the face of such firmness, but also open availability, is only that of having listeners who are equally receptive and open to dialogue and comparison.
