Hunting: Liguria, the Council of State returns validity to the Hunting Calendar, satisfaction from the Coordination of the Ligurian Hunting Associations for the ordinance that reopens hunting.
The Council of State has with ordinance number 4683/2013 recognized the validity of the regional hunting calendar approved by resolution of the Regional Council last May, excluding the water rail from huntable species, establishing the legitimacy of the additional days for hunting from stalking is legitimate for the species that make up more than 90% of the animals: wood pigeon, blackbird, song thrush, redwing and cesena and restoring the use of lead bullet ammunition for hunting ungulates. Councilor Briano has guaranteed that in the shortest possible time the communication to the interested bodies will arrive from the regional offices regarding the resumption of the hunting activity and its modalities. On the matter, the Coordination of the Hunting Associations of the Liguria Region has issued the following press release signed by the regional coordinator Matteo Anfossi:
With regard to the order of the Council of State no. 4683/2013 of today 27 November 2013 with which the hunting activity in Liguria is made practicable again with the rules set out in the first hunting calendar approved by the Regional Council last May (DCR n. 11 of 7/5/2013) the Coordination of the hunting associations of Liguria (Italian Federation of Hunting, ANUUMigratoristi, Libera Caccia, Arci Caccia, Enalcaccia):
He finds with satisfaction that the theses so much emphasized by the recurring associations have been rejected not only by the TAR Liguria but also by the Council of State.
He regrets the fact that for spurious and unfounded reasons and thanks to procedural quibbles, the Ligurian Hunters had to unjustly suffer the loss of numerous hunting days.
It undertakes to evaluate any further and future action aimed at defending the category and compensating for the damage suffered.
He thanked the Offices of the Liguria Region for the work done and for their commitment.
He thanks his lawyers from Prof Alberti's Genoese firm and in particular the Mozzati and Balletti lawyers for their support and excellent defensive activity.
In the meantime, however, the anti-huntsmen enjoy half a victory, since they have partly achieved the aim of closing the hunt during the winter migration of many bird species. In fact, the petitioner animal rights have thus commented on the decision of the Council of State, "The order 4683 of the Council of State filed this afternoon reopens various forms of hunting in Liguria, but the objective has nevertheless been achieved".
In fact, continuing the recurring animal welfare associations, WWF, Lega abolizione Caccia and Verdi, explained, "Wood pigeons and bird species of the turdidae family have largely reached the African wintering areas, undisturbed in Liguria (thanks to the 3 judicial stops) in peak period for the transition, that is from mid-October to the end of November We are therefore 'grateful' to the regional administrators who with their ignorance (for example the inclusion of a protected species in the list of huntable exceptional protectionist result in Italy ".
The huntsmen then recall "that all these steps concern only the urgent precautionary aspects", and that the pronouncement on the merits "will take months, and will arrive when the hunting season is already over. Furthermore, the administrative appeals judges, recognizing the goodness and novelty of the appeal, compensated the parties for the legal costs and underlined that the derogation for an additional two days of hunting per week (in addition to the canonical three) in the months of October and November to migratory species, it was legally fallacious for most huntable birds ”.
Finally, the animal rights activists recall that "the TAR Liguria, on August 23, condemned the Liguria Region with a judgment of merit n. 1130 for the use of lead ammunition in hunting ungulates with regard to last year's hunting calendar, and therefore this practice does not seem legitimate even for this year ”.
