THENational Free Hunting Association has made known through an official press release the formal request forwarded to Lazio Regional Administrative Court to urgently fix the discussion of their appeals. This is the step immediately following the challenge of the resolutions of the Council of Ministers with which it was the closing of the hunting season is anticipated in various Italian regions. As pointed out by Libera Caccia, the pronouncement by the Tar is an indispensable action, given that it is necessary to clarify once and for all who is the holder of the powers and faculties between the State and the Regions, without forgetting the dividing lines between these competences.
Only after understanding these differences will the Regions themselves have the possibility of prepare the calendars for the 2016-2017 hunting season, operation to be carried out within the next 15nd June. The association also hopes that the provision can be adopted in strict compliance with international standards: at the same time, however, there is no need to risk once again that the Government exercises the substitute power as happened last January. a behavior that has aroused an endless series of controversies.
Incidentally, what was least liked when looking at the exercise of substitute power was the way of choosing the timing, defined by Free Hunting "detrimental to the prerogatives of the Regions and therefore also to the interests of hunters". The request of the category is to have the guarantee of legal certainty. In the withdrawal request, the association's lawyers retraced the legal history of this affair. First of all, on 10 February there was a hearing in the council chamber for the joint discussion of the precautionary request for suspension of the contested replacement measures, during which the merit appeals were arranged for.
Libera Caccia highlighted above all how the substitute power in question is repeated from year to year with the same timing and methods, precisely detrimental to regional prerogatives. As happened exactly one year ago, the choice of the Council of Ministers caused many problems. The species for which early closure was requested (20 January instead of 31, as originally planned) were the song thrush, the woodcock and the cesena. In fact, seven regions have been commissioned, namely Liguria, Umbria, Lombardy, Tuscany, Calabria, Puglia and the Marches. An encouraging sentence was that of the Regional Administrative Court of Liguria which in fact proved the applicants right and rejected the solution of the Council of Ministers.
