The first section of the Regional Administrative Court of Sicily expressed itself on the appeal presented by a man to whom the Agrigento Police Headquarters had denied the release of the rifle port license for clay shooting use. The reason is obvious: this person's son was sentenced in 2007 for beatings, insults and threats and according to the Police Headquarters, the family relationship cannot exclude the possibility of abusing the parent's weapons, even if the two they are not cohabiting.
The issue of the license also requires the maximum transparency of the family environment to ensure public safety and police authorizations can be denied in case of lack of proof of good behaviour. The no of the Police Headquarters was based on the possible attendance of the owner's home by the son, but the administrative judges did not consider these reasons valid for the refusal.
Il simple family relationship with a person affected but not cohabiting is not sufficient to materialize the abuse of weapons. Therefore the appeal was accepted, with the consequent annulment of the contested provision. The administration was also ordered to pay the litigation costs in favor of the applicant, to be precise one thousand euros.
