The Fifth Section of the Regional Administrative Court of Campania has expressed himself in these days on 72 hours necessary to report the purchase of weapons. In particular, the judges examined the appeal of a man against the Ministry of the Interior and the Caserta Police Headquarters. The same Quaestor had revoked the license to carry a hunting rifle in February 2017. What exactly had happened? The requirements of reliability and good conduct, given that the complaint relating to the purchase of a rifle took place beyond the 72 hours required by law.
The hunter explained that he had a fever and gastroenteritis, a clinical condition he required four days of rest and that, once he arrived at the police station, the regularization staff were not present. The judges of the TAR accepted the appeal. The danger of gun abuse must be ascertained by an adequate assessment of the personality of the license holder.
In this case there was no evaluation, furthermore the personal situation of the man was considered an isolated fact and incapable of forming a judgment of danger. The appeal was upheld due to the lack of preliminary investigation and motivation, consequently the measure of the Caserta Police Headquarters was definitively canceled.
