I Roccoli in relation to the Community Directive 147 of 2009: this is the title of the dossier presented by Enalhunt to try to "unhinge" the formal notice by the European Commission. In a nutshell, Brussels believes that Italy has violated this regulatory text, better known as the "Birds Directive" regarding the capture of live calls. The community procedure has prompted the Lombardy Region to decide that in 2017 the catches must be suspended, even if there is no ruling that says this.
The association's dossier relies on tradition of roccoli in Lombardy. The plants where the birds are captured have a history spanning over 500 years. Furthermore, this activity must in no way be compared to fowling, which is instead prosecuted from a criminal point of view. Article 9 of the Birds Directive allows for a derogation from the ban on capturing birds in the presence of certain situations.
For example, there must be no alternative solutions or conditions must be strictly controlled. According to Enalcaccia, these conditions are met precisely and accurately in Lombardy thanks to the roccoli. Consequently, the roccoli themselves and the activities that take place inside must be considered fully compliant with the Birds Directive.
