"Finally these hunters, while they spend their days chasing and eating game, do not draw any other fruit from their assiduous and tiring exercise, if not to become so many wild beasts: nevertheless they believe in themselves to lead a royal life!”(Erasmus of Rotterdam, In Praise of Madness). The above quotation, although extrapolated from the well-known allegorical satire essay dating back to 1509, appears to be incredibly current, since, with all evidence, it summarizes the dominant "how wrong" conception in terms of hunting. Unfortunately, this conviction, as well as in the well-known radical chic / animal rights lounges, has for some time now pervaded politics, significantly influencing the work to the detriment of hunters, who, like all other citizens, also they deserve due respect and consideration. Today, at the Campania region, it was intended to confirm, once again, the remoteness of politics from the hunting world and from its legitimate requests, shared, lastly, also by farmers who, together with hunters, live, daily and directly, the territory, feeling painful for the its care and conservation.
Unreasonably, we did not want to take note of the profound change that, nowadays, permeates the hunting world and its representatives, which, anachronistically, by many, are criticized for portraying only "the fruit of their assiduous and tiring exercise". It is not clear the reason that induces, still, to ignore the deep interest that the modern hunter has for a correct “and real, indeed realistic” management of the territory and of the wild fauna, all in close and essential synergy with the agricultural world. Clearly, politics has not yet reached that degree of maturity / sensitivity necessary to understand the absolute need to involve the hunting world in land management and hunting planning activities, accepting their collaboration, both in the technical and legal fields.
Let's move on to the facts! On the day of April 2021, 14, when the Councilor for Agriculture of the Campania Region had accepted a request for a hearing, via videoconference, made by the writers AAVV, the illusion was generated in the latter that, finally, that was materializing. coveted, virtuous, collaboration between politics and the world of hunting. Unfortunately, the illusion vanished in less than fifteen minutes, the time that the Councilor for Agriculture of the Campania Region decided to dedicate to the AAVV, from 45:15 to 00:14, although the hearing was scheduled for 00 pm, when the applicants were already, on time, connected.
Once again, the policy decided not to accept the offer of collaboration, on a technical / wildlife theme, through the institutes that the major AAVVs are equipped with, as well as the request not to introduce further, senseless, restrictions in drawing up the hunting calendar. , urging its adaptation to those of neighboring regions. The Councilor for Agriculture, without granting the possibility of replying to the AAVV representatives, since, more usual, in his opinion expected from further urgent commitments, he limited himself to observing that the Campania Region intends to apply, to its maximum extent, the so-called . precautionary principle, manifested a willingness to compare which, then, did not find concrete confirmation / follow-up. In fact, although, during the hearing he was assisted by his numerous collaborators / experts in the field of hunting, as well as administrative staff of the sector, the Assessor took great care not to identify, among these, the person in charge of starting a dialogue with the hunting world.
Further confirmation of the adverse weather that is prefigured for hunting can be found in the press release issued by the Department of Agriculture today where, on the one hand, it would seem that the hunter is recognized a significant role in the protection of nature, by 'another is stated: “the hunting world should have the courage to initiate a change and rethinking, even on the formulas and times of sampling which today seem insurmountable taboos. Such rethinking and re-proposing must not have the flavor of the defeat of the hunting world compared to the claims of the most radical environmentalism… ”. Therefore, “further” restrictions and limitations, a clear refusal to confront the AAVVs and the agricultural world, but, on the other hand, a sure acceptance of the requests of the animal rights world.
Finally, it is not clear why, according to the Councilor, the need to provide the hunting policy with the "character of innovation and future projection" is essential to the introduction of further limitations, but it can well do without from the acceptance of sensible and scientifically proven requests from the world of hunting. Evidently, the Campania Region needs valid and competent advice on wildlife, as well as legal matters; it is known that the resolution of the Campania Regional Council of 29.12.2020, containing “Modification of the 2020/2021 Hunting Calendar (DGR n. 322 of 30.06.2020); Approval of variation: "rescheduling of the venable periods even beyond the deadlines set in the hunting calendar currently in force for those species for which the national legislation provides for it (Law no. 157/92, art. 18)", on appeal proposed by the WWF , was annulled by the Naples TAR which found a clamorous procedural error, in particular "... the violation of the principle of due process, as the modification made to the hunting calendar by means of the contested measures cannot be adopted without following the same procedure prescribed for its approval, and therefore "having heard the ISPRA and the CTFVR", which, in the present case, have not been summoned ... "(see TAR Naples, precautionary order no. 187/2021 of 27.01.2021).
The order in question was subsequently confirmed with sentence no. 2394/2021, published on 14.04.2021, where further confirmation of the procedural error put in place by the Campania Region is further confirmed. of paragraph 1 of art. 24 of the l. r 2672012, according to which "the regional council, having heard the ISPRA and the CTFVR referred to in article 8, by and no later than June 15, publishes the regional calendar and the regulation relating to the entire hunting year for the and for the species referred to in article 15, with the indication of the maximum number of animals to be killed for each hunting day. "
The aforementioned provision is certainly applicable, since it is regional legislation, special with respect to the national one, referred to by the defense of the Region (which is singular that it tries to disregard the rules approved by itself). However, according to the principle of contrarius actus, the contested amendment deed had to be subjected to the same procedure followed for the adoption of the original deed, which had involved the CTFVR ”. The writers AAVV, absolutely astonished at the casual ease with which, systematically, the dignity of the Hunters is mortified, will monitor with the utmost attention on the work of the Campania Region, reserving the right to request, if necessary, the competent Judicial Authority to assess the legitimacy and legality of the acts / measures being adopted. Evaluate the Department of Agriculture of the Campania Region to initiate a confrontation with the AAVV, serene and equal, in order to really connote the hunting policy of the "character of innovation and future projection", advocated in the press release issued in today. Failing that, the hunter, being also a citizen and voter, will not be able to refrain from evaluating, in an extremely negative way, this "hostile" attitude of closure.
