A new negative sentence
Another administrative sentence, yet another decision against the hunters. This time to challenge the choices of a TAR are the Sardinian shotguns, grappling with an appeal accepted in favor of the association Earth. The latter has lashed out against the Sardinia Region and among the parties involved there are the hunting acronyms Enalcaccia and Caccia Pesca Ambiente, both of which appeared in court. The part of 2022-2023 calendar the subject of the appeal was that relating to the withdrawal of pochards and lapwings until the next 29st January.
Withdrawal and game bags
In a nutshell, the appellant association challenged the hunting calendar 2022/2023 limited to Annex 1 in the part in which the hunt for the Pochard is foreseen starting from 18 September and until 29 January 2023, with a withdrawal limited to three seasonal items, and to the Pavoncella, starting from 13 October 2022 and until 29 January 2023, with a withdrawal of five items a day and 25 seasonal items.
The words of the judges
Among motivations of the Regional Administrative Court you can also read the following: "With note prot. n. 39696 of 28 May 2020, the Ministry of the Environment for the Protection of the Territory and the Sea (MATTM) had justifiably proposed to exclude the Pochard from the hunting calendars, also in order to avoid the risk of the Commission starting an infringement procedure European Union, and that ISPRA, in the opinion sent on July 26, 2022 to the Autonomous Region of Sardinia, explicitly referred to the aforementioned note of the MATTM".
