Il Council of State spoke a few days ago on the firearms license and on an option on which there is usually little light. We are talking about the appeal for the return of the license which can be presented directly to the President of the Republic. As it is easy to guess, this solution is extraordinary and concerns a final decision by the judges. Based on what is read in the pronunciation, the case was that of a man who asked for "help" at the Quirinale against the decree of the Prefect of Florence which had prohibited the possession of weapons and ammunition for him.
Furthermore, this person has been recognized as not being absolutely reliable in this matter. Before the President of the Republic, the appeal must be presented to bodies in charge in two ways, referring to the Ministry of the Interior or as a judicial procedure.
According to Presidential Decree 1199 of 1971, the President of the Republic can be involved in an extraordinary way motivating the appeal with legitimacy. The same appeal to the Quirinale, on the other hand, is not allowed if the deed is challenged with a judicial appeal.
