By order published on 20 September 2019, the First Section of the Tar of Bari [President Scafuri - Rapporteur Allegretta] rejected the request presented by the Verdi Ambiente Onlus Association with which the hunting calendar regional for the 2019/2020 vintage. In the aforementioned judgment, against this request, it appeared the National Free Hunting Association, in the person of the Regional President Flavio Maglio, who entrusted the defense of his reasons to Attorney Danilo Lorenzo e Sergio Camassa.
In detail, the Verdi Ambiente Association had censured the legitimacy of the Regional Hunting Calendar from various points of view because it was in contrast with the opinion of ISPRA, both with reference to the pre-opening and post-opening periods of the hunt, and for the hunting for the different huntable species. The other complaints against the Hunting Calendar focused on the type of ammunition used in hunting ungulates, on the harvesting periods of certain huntable species, on the regional mobility of hunters and on the methods of use of resin or plastic barrels used in aquatic hunting.
During his speech theNational Free Hunting Association - regional office of Puglia, through the aforementioned Lawyers Danilo Lorenzo and Sergio Camassa, dismantled all the complaints produced by environmentalists and highlighted the non-binding nature of the ISPRA opinion, full compliance with the regional hunting calendar in Art. 18 of the law n. 157/1992 which lists the huntable species and the periods of hunting activity. Our trusted lawyers shared and supported the motivations of the Puglia Region, having promptly and in detail motivated the reasons for which it had intended to allow the hunting of individual animal species in the periods of time indicated therein, motivations and arguments characterized by both content of character technical-scientific, and from the peculiarities of the Apulian Region.
With the aforementioned Ordinance, the TAR Bari rejected the request for suspension of the Regional Hunting Calendar, giving reason to the National Association of Free Hunting and thus saving the entire hunting season in the Puglia Region. “I am particularly satisfied with the result obtained”, commented the regional President of the National Free Hunting Association Flavio Maglio, who said he was increasingly convinced of the choice made to appear in court independently. If we had not done this we would not have achieved this result. As proof of this, it is sufficient to re-read the briefs prepared by our lawyers to understand the validity of the observations. Indeed “The Ordinance of the TAR Bari follows many of the reasons supported by our association. The Apulian hunting calendar has perfectly combined both the needs of hunting, which is and remains a perfectly legal and legitimate activity, and the needs of the environment and fauna where it is considered that - rightly - a maximum number of huntable species is imposed for every day of hunting and in any case a maximum slaughtering ceiling during the entire opening period. They are also well protected and respected the nesting, wintering and transit periods of the species. Hunting is and remains a sport and a passion that cannot ignore respect for the environment and in this the TAR of Bari has certainly approved the content of the Apulian Hunting Calendar ”.
A personal thank you from me and from all the Association that I represent at various levels I would like to address to our lawyers Sergio Camassa and Danilo Lorenzo for having known more and better than others to represent the technical and legal reasons that presided over the drafting of the calendar hunting. Although not a man of law, I can assure you that theirs was an unparalleled intervention, for having engaged in a defense of hunters on the basis of the arguments set out above that could not be certain that of the payment of taxes which, as such, would have given them the right to hunt.
