The TAR of Trento has in fact confirmed the full legitimacy of the decree with which the Police Headquarters denied the renewal of the document. Even before addressing the question on the merits, the TAR makes a premise recalling that "our legal system does not recognize the absolute and incompressible right of single possession of a weapon and the use of the same. The issue or renewal of the license to bear arms represents, in fact, a derogation from the general prohibition on carrying arms ”. Furthermore, the administrative judges recall that "the license to bear arms presupposes the existence, as well as thereliability in their use on the part of the applicant, also of the requirement of so-called good conduct, which indeed has a wider application latitude than the danger of abuse with the consequence that the rifle port license can be issued or maintained only to a person who is absolutely free from mendes and who observes a life conduct based on punctual compliance with criminal law and the protection of public order, as well as the common rules of good civil coexistence».
And again: "The not-so-dating era of the contested conduct and the conduct itself denoting a personality prone to excess and little control justifies the prognostic judgment of the administration, which can be deduced in particular in the provision of the Government Commissariat, according to which the previous alcohol abuse can lead to the abuse of weapons. It is true that the person who has abused alcohol cannot in any case be considered sine die unreliable, however objectively it is not manifestly unreasonable by the public safety authority. having considered the elapsed time still insufficient, equal to six years, in order to believe that the problems of abuse in question have been overcome and, therefore, to have considered the issue of the applicant's license to bear arms still premature ».
