La First Section of the Regional Administrative Court of Piedmont spoke a few days ago on the case of a man who was banned from possession of weapons and ammunition. The Turin Police Headquarters had adopted this provision due to a conviction reported for violation of the Highway Code. In short, this person had been stopped while driving in a state of alcoholic alteration.
As a result of this fact he was not considered suitable for possession of the firearms license, which is why there was an appeal. The judges of the TAR accepted it, an important precedent in this area. In fact, a single isolated episode must be assessed with caution: the man's fault was slight and cannot be configured as an index of propensity to violate the rules. Therefore, other circumstances are needed for a more in-depth assessment.
The episode of driving in a state of intoxication was judged to be of little relevance by the Piedmontese TAR just a year ago, therefore this legal approach must be followed. The contested measures have been challenged and the applicant regained his hunting license. The position of the man will still have to be reassessed on the basis of new medico-legal checks regarding the use of alcoholic substances if they are deemed necessary.
